Documents Required
  1. A simply signed Power of Attorney which does not require notarization and legalization;

  3. The applicant’s complete name and address;
  4. List of goods/services to be covered by the trademark;

  6. If priority is claimed, a certified priority document must be submitted to the Indonesian IP Office within 3 months from the filing date.
Procedure / Time Frame

Under Indonesia’s current practice, the estimated time frame from the filing of an application to the issuance of Registration Certificate for a smooth trademark application is approximately 14 to 16 months. The Trademark Office (“TMO”) has developed new administrative of trademark application filing process to expedite the trademark registration process in Indonesia. A substantive examination which formerly took 12 months are now reduced to 9 months from the filing date (assuming no objections or office actions were filed). With this change, the trademark registration process will be significantly shortened from up to 16 months to 12 months.

Validity / Renewal

Trade mark registration is valid for ten years from the date of application and may be renewed every 10 years. A request for trademark renewal should be filed within six months prior to the expiration of the registration or within a six-month grace period after the expiration date provided that a surcharge is paid.

Direct National Application:-

  1. Filing form request for the grant of a patent
  2. Applicant's name and address;
  3. Inventor's name and address;
  4. A specification comprising a description, claims and any necessary drawings;
  5. the country and filing particulars of basic application whose priority is claimed;
  6. Form for the appointment of patent agent; and
  7. Filing of an assignment from inventor to applicant.

PCT National Phase Application:-

  1. A copy of the PCT application in English language (i.e. PCT/RO/101);
  2. The details of the PCT application as published by WIPO;
  3. PCT specification as originally filed;
  4. International Preliminary Report on Patentability;
  5. Amendments filed in the international phase (if any);
  6. Power of Attorney; and
  7. Filing of an assignment from inventor to applicant.
Specific Remark
    1. A scanned copy of the simply signed Power of Attorney must be submitted at the time of filing application.

 

  1. If an application is filed by a person or legal entity other than the inventor, it is necessary to provide a scanned copy of the signed Assignment Deed between the applicant and inventor. The Assignment Deed may be filed at the time of filing the application or within 3 months from the filing date.
Procedure / Time Frame
  1. Filing of Patent Application

    Applicant is required to submit an application within 12 months of priority date.

  2. Publication

    A patent application will be published within 18 months of the filing date.

  3. Opposition

    The publication will span a duration of six months, during which interested parties are invited to submit oppositions. Statements of opposition and counterstatements will be duly considered in the examination stage.

  4. Substantive Examination

    A request for examination must be filed within 36 months after the application filing date; failure to do so could result in the automatic withdrawal of the application. Additionally, a simple patent undergoes examination solely for novelty.

  5. Registration

    The patent office is obligated to either grant or reject a patent within 36 months after the receipt of an examination date. Upon successful completion of examination, the office will issue a patent certificate, and the invention will be listed in the general register of patents.

Validity / Renewal

The official grant fee should be paid within 1 month as of the date of issuance of the notice of allowance. A patent in Indonesia is valid for 20 years from the filing date. Annual maintenance fees are due each year starting from the 1st one and are payable after the patent is granted. Annuities which were due before the grant should be paid within 6 months from the issuance of the Notice of Allowance, plus the annual fee for the next year.

Specific Remark
  1. A signed Power of Attorney must be filed at the time of filing. No legalization or notarization is necessary.

Procedure / Time Frame
  1. Application

    Every design application has to be filed with the Indonesian Patent Office. Incomplete applicants will be given 3 months for rectification, else the application will be deemed withdrawn. An application number and filing date will be issued on submission of the application.

  2. Publication and Opposition

    Applications will be published for 3 months from the filing date. Oppositions are invited during the publication period from concerned parties. A counter statement for the same has to be submitted within 3 months after the date of receipt of notification from the Director General.

  3. Substantive Examination

    A substantive examination will be conducted only during oppositions. Opposition and counter statements are taken into consideration during the examination. The decision of registration or vice versa is not to 6 months after the expiration of the publication period.

  4. Registration

    The official fee for filing of a design certificate is to be paid within one month upon receipt of the Notice of Allowance. Industrial designs registered before the Indonesian IP Office are valid for 10 years from the filing date. Renewal is not available, thus, maintenance fees are not applicable.
